This English version is provided for convenience. The legally binding version is the German original. In case of any discrepancy, the German text prevails.

General Terms and Conditions


1. Scope and contracting party

These General Terms and Conditions (GTC) apply to all orders placed via the online shop at mintlama.eu. The contracting party is:

The inclusion of the customer's own terms is hereby objected to, unless otherwise agreed.

A consumer within the meaning of these GTC is any natural person who concludes a legal transaction for a purpose that can be attributed neither to their commercial nor to their independent professional activity. An entrepreneur is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their independent professional or commercial activity.

2. Conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer but an invitation to order. By clicking the order button, the customer submits a binding offer to purchase the goods in the shopping cart.

Orders may be placed with or without a customer account. With an account, the customer can view past orders and save data for future purchases. As a guest, only the mandatory data required for processing is collected.

All information about goods provided during the ordering process is non-binding. Changes in design and technology that do not alter or improve product functionality, as well as erroneous descriptions, images and price information, are reserved. Information on promotions applies only as long as stock lasts.

The customer receives an automated order acknowledgement by e-mail after submitting the order. This acknowledgement does not constitute acceptance of the offer. The contract of sale is concluded once we accept the order with an order confirmation or dispatch the goods.

The customer is responsible for the accuracy and completeness of their information and must ensure that the e-mail address provided for order processing is valid and that spam filters are configured to receive our e-mails.

3. Prices and shipping cost

All prices are quoted in Euro (EUR) and include the applicable statutory VAT. Shipping cost is shown separately before the order is finally placed. Details: Shipping & Delivery.

4. Payment terms

Credit/debit card, Apple Pay, Google Pay, SEPA Direct Debit, iDEAL, Bancontact and Klarna (each via our payment service provider Stripe) as well as bank transfer (advance payment) are available. Details: Payment Options. Goods are shipped after payment is received. For advance payment, the amount must be received within 14 days of order, otherwise we may cancel the order.

For business customers, purchase on invoice may be agreed in exceptional cases. The payment term is generally 10 days from receipt of the invoice. Other payment modalities may be agreed separately between seller and business customer.

If payment is not made on time, the customer is in default and will be reminded by e-mail or post. In case of payment default after written reminder, processing fees of EUR 15 per reminder stage may be charged, plus statutory default interest (base rate plus 5 percentage points for consumers, plus 9 percentage points for business customers).

For business customers we also reserve the right, in case of cancellation of a binding order outside of statutory withdrawal rights, to charge a reasonable handling fee to cover processing costs.

5. Delivery and shipping risk

We deliver only to addresses in the countries listed under Shipping & Delivery. For consumers, MINT LAMA Europe OÜ bears the shipping risk until handover of the goods. If a product becomes unavailable after order placement, we will inform the customer without undue delay and refund any payments received.

If the carrier returns the shipment to us because delivery to the customer was not possible (e.g. wrong address, refusal of acceptance, failure to collect at the parcel shop in time), the customer bears the costs of the unsuccessful shipment and any subsequent re-delivery.

In case of an incorrect delivery by MINT LAMA Europe OÜ, the return postage will be reimbursed to the customer. For goods returned in proper condition, no further costs incurred will be reimbursed.

6. Right of withdrawal for consumers

Instructions on withdrawal

Consumers have the right to withdraw from this contract within 15 days without giving any reason. We voluntarily grant one day more than the statutory minimum of 14 days.

The withdrawal period is 15 days from the day on which the customer or a third party named by the customer, who is not the carrier, takes possession of the goods. In the case of partial deliveries, the period starts upon receipt of the last partial delivery.

To exercise the right of withdrawal, the customer must inform us (MINT LAMA Europe OÜ, Järvevana tee 9, 11314 Tallinn, Estonia, e-mail info@mintlama.ch, phone +41 44 589 70 15) of the decision to withdraw by means of an unambiguous statement (e.g. letter sent by post or e-mail). The model withdrawal form below may be used, but is not mandatory.

To meet the withdrawal deadline, it is sufficient to send the communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If the customer withdraws from this contract, we will refund all payments received from the customer, including delivery costs (except for the additional costs arising from the customer's choice of a delivery method other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we receive notice of the withdrawal. We will use the same means of payment as the customer used for the original transaction, unless expressly agreed otherwise; in no case will the customer be charged any fees for this refund.

We may withhold the refund until we have received the goods back or until the customer has provided evidence of having returned the goods, whichever is earlier.

The customer must return the goods without undue delay and in any case no later than fourteen days from the day on which the customer notifies us of the withdrawal. The deadline is met if the customer dispatches the goods before the fourteen-day period has expired. The customer bears the direct costs of returning the goods.

The customer is only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods. Such inspection means handling as would also be possible in a brick-and-mortar shop. Use going beyond such inspection that may lead to a liability for diminished value includes in particular: immersing the goods in water (e.g. SUP boards, snorkels, diving equipment), inflating and water-testing SUPs, taking snorkels and mouthpieces into the mouth, as well as loss or damage of the original packaging. The original packaging must remain complete and undamaged.

Exceptions to the right of withdrawal

The right of withdrawal does not apply to contracts for goods made to the customer's specifications or clearly tailored to personal needs (e.g. customised pre-order productions). Such exclusions will be highlighted separately before conclusion of the contract.

7. Warranty and guarantee

Statutory warranty rights apply. For consumers the warranty period is 2 years from handover of the goods. In case of defects the customer is entitled to subsequent performance (repair or replacement); if this fails, the customer may reduce the price or rescind the contract.

In addition we grant a manufacturer's guarantee of 24 months from the date of purchase on products of the MINT LAMA brand. For direct orders placed via mintlama.eu we voluntarily extend this guarantee by an additional 12 months (24 + 12 months; third-party brands are excluded).

The guarantee does not apply to defects caused by the customer, e.g. improper handling, self-repair attempts or incorrect assembly. For second-hand and sale items the guarantee is excluded or applies only as agreed in writing.

For complaints please contact us at info@mintlama.ch in advance so that we can communicate the return address. Repairs may leave visible cosmetic traces (e.g. PVC patches) without affecting functionality.

8. Liability

We are fully liable for intent and gross negligence as well as under product liability law. For slight negligence we are only liable for breach of material contractual obligations (cardinal obligations) and limited to the contract-typical, foreseeable damage. Further liability is excluded. The limitation of liability does not apply in cases of injury to life, body or health.

Distributors and suppliers exclude any liability arising from negligent or unintended use (e.g. damage, injury, death).

9. Returns

When exercising the right of withdrawal or returning goods in case of a complaint, please note:
– Check the goods immediately upon receipt and report defects without delay.
– Return the goods in the original packaging, undamaged, unused and clean to the extent reasonable (see note on diminished value above).
– Always announce returns in advance at info@mintlama.ch so we can communicate the correct return address.
– For returns not announced in advance, additional handling costs from our logistics partner may apply and are borne by the customer.

10. Best price guarantee

MINT LAMA Europe OÜ grants a best price guarantee on identical, in-stock products of the MINT LAMA brand within the European Union. If you find the same product offered by another EU retailer at a lower price at the same time, send the link to info@mintlama.ch. After review we will confirm the lower price by adjusted order confirmation. The adjusted amount must be transferred within 7 days of confirmation, otherwise the offer expires.

The best price guarantee cannot be combined with the extended manufacturer warranty (24 + 12 months). If this occurs, the customer will be informed and can choose between best price and extended warranty.

Excluded are private sales, auction platforms, insolvency sales and other non-regular sales channels. Promotion vouchers cannot be combined with the best price guarantee.

11. Data protection

We process personal data in accordance with the General Data Protection Regulation (GDPR) and Estonian data protection laws. Details: Privacy Policy.

12. Dispute resolution

The EU Online Dispute Resolution platform was shut down on 20 July 2025 and no longer exists. There is therefore no obligation to link to it.

We are not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board. We aim to resolve any differences directly with the customer — for complaints please contact us first at info@mintlama.ch.

13. Applicable law and jurisdiction

The contractual relationship is governed by the law of the Republic of Estonia, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the country in which the customer has their habitual residence remain unaffected.

Place of jurisdiction for disputes with entrepreneurs is Tallinn, Estonia. For consumers, the statutory place of jurisdiction at their residence applies.

14. Contract language and translations

The contract language is German. These GTC are also provided in other languages (English, French, Italian, Dutch, Spanish) for information. In case of doubt and for interpretation, only the German version is binding.

15. Working days and deadlines

Where deadlines are stated in working days, this means all weekdays with the exception of Saturdays, Sundays and statutory public holidays at the registered office of MINT LAMA Europe OÜ (Estonia), at the location of our logistics partner (Germany, where shipping from DE applies) as well as at the location of our customer service team (Switzerland).

16. Final provisions

Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by an effective regulation that comes as close as possible to the economic purpose of the invalid provision.
